Abstract
سن المرسوم رقم 21-432 قواعد جديدة لاستصلاح الأراضي التابعة للملية الخاصة للدولة في إطار الامتياز، تختلف عن تلك التي كان معمولاً بها في القوانين السابقة، وهو القانون رقم 83-18، والمرسومان التنفيذيان رقم 92-289، ورقم 97-483، لا سيما من حيث تكريس مبدأ عدم قابلية الأرض المستصلحة للتنازل، حيث يمنح الامتياز لمدة أربعين سنة قابلة للتجديد، بطلب مكتوب سنة قبل نهاية الامتياز، مقابل دفع المستفيد إتاوة سنوية تحددها قوانين المالية، وهو حق قابل للانتقال للورثة بعد وفاة صاحب الامتياز، ويمنح الامتياز بموجب عقد إداري تحرره مصالح أملاك الدولة، يخضع للتسجيل والشهر العقاري، مرفق بدفتر الشروط موقع ومؤشر عليه، وهو ينتهي نهاية طبيعية بانقضاء مدته، أو بالاتفاق أو الفسخ الإداري في حالة إخلال المستثمر بالتزاماته القانونية.

Abstract:
Decree No. 21-432 established new rules for the development of state-owned private land under a concession agreement. These rules differ from those in force under previous laws, namely Law No. 83-18 and Executive Decrees No. 92-289 and No. 97-48, particularly by enshrining the principle of the inalienability of the developed land. The concession is granted for a period of forty years, renewable upon written request submitted one year prior to its expiry, subject to the beneficiary's payment of an annual fee set by financial legislation. This right is transferable to heirs after the holder's death. The concession is granted under an administrative contract drawn up by the State Property Department, subject to registration and publication in the land registry, and accompanied by a signed and initialed booklet of general terms and conditions. It terminates automatically upon the expiration of its term, or by mutual agreement or administrative termination in the event of the investor's failure to meet their legal obligations.
