dc.description.abstractتعد جريمة المساس بنزاهة نظام الامتحانات والمسابقات من الجرائم الأكثر انتشارًا على مستوى العالم، ويُعزى ذلك إلى التطور التكنولوجي الذي أفرز ظاهرة الغش، والتي باتت شائعة في عدة مجالات، ولا سيما في قطاعي التعليم والتوظيف. هذا الأمر دفع المشرّع الجزائري إلى تجريم أفعال مثل الغش، أو نشر أو تسريب مواضيع الامتحانات، أو انتحال صفة المترشح، من خلال نصوص قانونية تُحدّد العقوبات المترتبة عليها، سواء كانت غرامات مالية أو عقوبات سالبة للحرية. وقد تجسّد ذلك في صدور الأمر رقم 20-06 المؤرخ في 20 أبريل 2020، المعدِّل والمتمِّم لقانون العقوبات. وقد تناولت هذه الدراسة هذا الموضوع من الناحية الجزائية، من التعرض لإجراءات التحقيق في هذه الجريمة، إلى جانب استعراض أحكام التجريم والعقوبة المتعلقة بالمساهمة الجنائية في جريمة المساس بنزاهة نظام الامتحانات والمسابقات الرسمية. Abstract: The offense of undermining the integrity of the examination and competition system is among the most widespread crimes in many regions around the world. With technological advancements, various forms of fraud have emerged, particularly in the fields of education and employment. This situation prompted the Algerian legislator to criminalize acts such as cheating, the publication or leakage of information, and the impersonation of candidates through legal texts that specify penalties, whether financial fines or custodial sentences. This legal approach wasconcretized through Ordinance No. 20-06 of April 20, 2020, which amended and supplemented the Penal Code. From a criminal law perspective, this study addresses the investigative procedures related to this type of offense, as well as the legal provisions concerning the criminalization and sanctioning of criminal participation in acts that undermine the integrity of official examination and competition systems.
