| dc.description.abstract | الملخـــــــص الأسرة هي الخلية الأساسية في المجتمع والطفل جزء لا يتجزأ منها فصلاح هذا الأخير من صلاح المجتمع، والاهتمام به في الصغر يؤطر إلى شاب ذو شخصية فعالة في الدولة مستقبلا. إن رعاية الطفل وحمايته عبء يقع على الأسرة والمجتمع أولا وهو ما أكدته الاتفاقيات الدولية والدساتير الوطنية، وفي المقابل تضطلع الدولة متمثلة في المشرع بحماية الطفل من كل اعتداء يقع مباشرة عليه أو على حق من حقوقه، مما يلحق به أضرارا بالغة وذلك في إطار التجريم والعقاب. مما سبق طرحه ومناقشته، يتجلى لنا أن القانون الجزائي في الجزائر حاول إحاطة الطفل بحماية جزائية وقائية ضد مختلف الاعتداءات والجرائم التي تمس حياته وصحته، ولم يغفل عن جانب العرض والأخلاق، بل امتدت حمايته للطفل حتى إلى رعايته الأسرية وذمته المالية، وما هو إلا تأكيد على حرص المشرع على حمايته. الحماية الجزائية الموضوعية للطفل ضحية الاعتداءات المختلفة، لا تحقق الغاية مادامت في ظل الجمود ضمن النصوص القانونية، بل تحتاج إلى الجانب الإجرائي الذي يخرج بها من دائرة الجمود إلى غاية تحقيق الهدف المنشود بإظهار الحق وتسليط العقاب بالجاني، وفي ظل المتابعة الإجرائية يفترض مراعاة خصوصية الطفل التي من أجلها أقر المشرع مجمل النصوص القانونية المجرمة للاعتداءات المختلفة التي يتعرض لها، وكيفية مباشرة الدعوى العمومية الهيئات المكلفة بحماية الطفل على مستوى عناصر الضبطية القضائية، ومخطط الإنذار إلى غاية تدخل قاضي الأحداث لحماية الطفل الذي تعرض إلى خطر مادي أو معنوي. Summary The family is the main cell in society and the child is an integral part of it, the latter’s goodness is the good of society, and his attention at a young age is framed by a young man with an effective personality in the state in the future. Child care and protection is a burden on the family and society first, as confirmed by international conventions and national constitutions, and in return, the State represented in the legislature protects the child from any attack directly or rightly committed against him or her right, causing serious damage withen the framework of criminalization and punishment. From the above, it is clear to us the the Penal Code in Algeria has tried to provide the child with preventive criminal protection against various attacks and crimes affecting his life and health, He did not lose sight of the aspect of presentation and morality, but his protection of the child extended even to family care financial disclosure, and is an affirmation of the legislator’s keenness the protect him. Objective criminal protection for children who are victims of various attacks does not achieve the end as long as they are in the midst of deadlock withen the legal texts, but need the procedural aspect that brings them out of the cycle of inertia to achieve the goal of demonstrating the right and punishing the offender. Under the procedural follow-up, it is assumed that the privacy of the child, for which the legislator approved all the legal provisions criminal to the various attacks to which he is subjected, how to initiate public proceedings, the bodies charged with protecting the child at the level of the elements of judicial control, and the warning scheme until the intervention of the juvenile judge to protect the child who has been exposed to a material or moral risk. | |
