| dc.description.abstract | يقصد بالزواج ذلك الرباط المقدس بين زوج وزوجة يخلوان من الموانع الشرعية، والذي يساهم في استمرار الحياة البشرية، أما الطلاق فهو فك للرابطة الزوجية ( سواء بالطلاق أو التطليق أم الخلع)، والذي ساهم في تناميه - حسب ما تناولنا في بحثنا- مواد متعلقة بأحكام الزواج إما خلت من إلزامية التكوين للمقبلين على الزواج، وإما نقص الوعي بضرورة توثيق شروط الزوجين في عقد الزواج، مع تأثير غياب الولي عن عقد الزواج، إضافة إلى غياب الوعي بضرورة إجراء فحص طبي شامل للزوجين قبل عقد الزواج ومدى مساهمة كل ذلك في فك الرابطة الزوجية، وأثر كل من القوامة والحقوق المشتركة بين الزوجين ومسألة قرار الزوجة في بيتها على استقرار العلاقة الزوجية واستمراريتها. أما بالنسبة للأحكام الخاصة بالطلاق المساهمة في فك الرابطة الزوجية فتمثلت في نقص فاعلية الصلح وغياب التحكيم في النزاعات الأسرية المعروضة على القضاء، دون أن ننسى دور الفقرة 10 من المادة 53، وتعديل المادة 54 من قانون الأسرة الجزائري وتأثيرهما تنامي ظاهرة فك الرابطة الزوجية في الجزائر Marriage refers to the sacred bond between a husband and wife, free from legal impediments, which contributes to the continuation of human life. Divorce, on the other hand, is the dissolution of the marital bond (whether by repudiation, divorce, or khul'). This growth has been fueled, as discussed in our research, by provisions related to marriage laws that either lack mandatory education for those intending to marry, or a lack of awareness of the necessity of documenting the spouses' conditions in the marriage contract. The absence of a guardian during the marriage contract also has a significant impact. Furthermore, there is a lack of awareness of the necessity of conducting a comprehensive medical examination of the spouses before the marriage contract, and the extent to which this contributes to the dissolution of the marital bond. Furthermore, there is a lack of awareness of the importance of guardianship, shared rights between spouses, and the wife's decision-making power in the home on the stability and continuity of the marital relationshi As for the provisions related to divorce that contribute to the dissolution of the marital bond, these are represented by the ineffectiveness of reconciliation and the absence of arbitration in family disputes brought before the courts. We must not forget the role of Paragraph 10 of Article 53 and the amendment to Article 54 of the Algerian Family Code, and their impact on the growing phenomenon of marital dissolution in Algeria. | |
