dc.description.abstractملخص العقد يُعتبر من أهم مصادر الالتزام، إذ ينصب ترتيب التزامات على المتعاقدين، ويجسد إرادتهما، مما يجعله شريعة لهما لا يجوز نقضها أو تعديلها إلا باتفاقهما. ومع ذلك، قد يواجه الأطراف صعوبات في تنفيذ التزاماتهم بسبب غموض في العقد، ما يتطلب تدخل القاضي لتفسيره بناءً على النية المشتركة للمتعاقدين. القاضي يواجه ثلاث حالات رئيسية في تفسير العقد، منها العبارات الواضحة والغامضة، وفي حالة الشك، يستعين بقواعد خارجية وداخلية للعقد. على الرغم من سلطة القاضي في التفسير، إلا أنه يخضع لرقابة المحكمة العليا، التي تقوم برقابة مسائل الواقع لكنها لا تتدخل في مسائل القانون، مما يظهر تقييمها لتسبيب النتائج التي يتوصل إليها القاضي، لأن المحكمة العليا تُعتبر محكمة قانونية بالدرجة الأولى. Summary Contracts are considered one of the most important sources of obligation, as they establish obligations for the contracting parties and embody their will, making it a law for them that cannot be revoked or modified except by their agreement. However, parties may encounter difficulties in fulfilling their obligations due to ambiguity in the contract, necessitating judicial intervention to interpret it based on the mutual intention of the parties. The judge faces three main situations in interpreting the contract, including clear and ambiguous terms, and in case of doubt, external and internal rules of the contract are employed. Despite the judge's authority in interpretation, they are subject to the oversight of the Supreme Court, which reviews matters of fact but does not intervene in legal issues, indicating its evaluation of the outcomes reached by the judge, as the Supreme Court is primarily a legal court.
