| dc.description.abstract | الملخص: الملكية العقارية في التشريع الجزائري هي حق التصرف وحق التمتع في الملك العقاري وفقا لطبيعتها أو غرضها في حدود القوانين والأنظمة المعمول بها،وتكتسب الملكية العقارية بعدة طرق قانونية وهي عن طريق الواقعة المادية أو الأحكام والقرارات القضائية، ويشترط في ذلك الكتابة والشهر في المحافظة العقارية،والملكية العقارية تثبت في التشريع الجزائري بواسطة سندات الملكية المتمثلة في الدفتر العقاري أو المحررات الرسمية الناصة على الملكية بموجب ضابط عمومي وهو الموثق، و من أجلالحفاظ على الأملاك العقارية و التصدي للاعتداءات على عليها، وضع المشرع الجزائري أدوات و وسائل حماية قانونية تتمثل في الحماية الإدارية، المدنية و الحماية الجزائية.
