| dc.description.abstract | الملخص : إستجابة لعصرنة العدالة الجنائية ، أقر المشرّع الجزائري في ظل الأمر رقم 15-02 المؤرخ في 23جويلية سنة2015 المعدل والمتمم للأمر رقم 66-155 المؤرخ في 8جوان سنة 1966 والمتضمن قانون الإجراءات الجزائية الجزائري آليتي الصلح والوساطة الجزائية كأنظمة قانونية مستحدثة ، تماشيا والتطور الحاصل في القطاع . حيث تساهم هذه الأنظمة في فض النزاع بطرق ودية بعيدا عن القضاء وذلك من خلال تقريب وجهات النظر بين أطراف النزاع سعيا وراء تحقيق عدالة ناجحة ومتوازنة . ومنه جاءت هذه الدراسة كمحاولة لإبراز مدى فعالية التطبيق الوقائي للصلح والوساطة للحد من الجريمة من خلال قراءة النصوص القانونية وتحليلها ،وذلك من أجل التخفيف من كثرة الدعاوى والمتابعات الجزائية في المحاكم والمجالس القضائية ،وسرعة الفصل فيها دون محاكمة Abstract: In response to the modernization of criminal justice, the Algerian legislator, under Order No. 15-02 of July 23, 2015, amending and supplementing Order No. 66-155 of June 8, 1966, which includes the Algerian Code of Criminal Procedure, approved the mechanisms of conciliation and criminal mediation as new legal systems, in line with the development taking place in the sector. These systems contribute to resolving the conflict amicably, away from the judiciary, by bringing the points of view between the parties to the conflict closer together in an effort to achieve successful and balanced justice. this study came as an attempt to highlight the effectiveness of the preventive application of reconciliation and mediation to reduce crime through reading and analyzing legal texts, in order to reduce the large number of lawsuits and criminal prosecutions in courts and judicial councils, and quickly decide them without a trial. | |
