| dc.description.abstract | يتناول هذا البحث دراسة موضوع عقد الصلح كأحد الاتفاقات التي تعتمد على رضا الأطراف، وذلك في القانون المدني الجزائري، حيث يهدف إلى إنهاء نزاع قائم أو منع نزاع محتمل قد يحدث بين طرفين أو أكثر، من خلال التنازل المتبادل عن بعض الحقوق أو تعديل الالتزامات، و يعتبر وسيلة بديلة لحل النزاعات ويتميز بالسهولة والفعالية مقارنة بالطرق القانونية. يعتمد هذا العمل على فحص النصوص القانونية المتعلقة به، وخاصة المواد من 454 إلى 460 من القانون المدني الجزائري، بالإضافة إلى الاجتهادات القانونية والمبادئ الأساسية العامة في القانون المدني، كما تم إجراء مقارنة مع بعض الأنظمة القانونية الأخرى لتسليط الضوء على الخصوصيات التي تخص تنظيم الجزائر لهذا الاتفاق. This research examines the topic of the settlement contract (contract of reconciliation) as one of the agreements based on the mutual consent of the parties, within the framework of the Algerian Civil Law. It aims to terminate an existing dispute or prevent a potential conflict that may arise between two or more parties, through mutual concessions of certain rights or modifications of obligations. It is considered an alternative means of dispute resolution, characterized by simplicity and efficiency compared to legal proceedings. This study relies on the analysis of the relevant legal provisions, particularly Articles 454 to 460 of the Algerian Civil Code, in addition to judicial precedents and general fundamental principles of civil law. A comparative approach with other legal systems was also adopted to highlight the specific features of how Algeria regulates this type of agreement. | |
