Abstract
ملخص:
المنافسة هي الوضعية التي يكون فيها بائعوا المنتوج أو الخدمات وذلك من أجل زيادة مداخيلهم بصفة ،بحيث يقترحون على الزبون أسعار جد مغرية مقارنة بمنافسيهم ولهذا تعد المنافسة أمر ضروري والزامي لسيرورة النشاط الاقتصادي، لكن قد تنقلب وتصبح عبنا على التجارة وعلى التاجر متى استخدمت فيها وسائل غير مشروعة ومخالفة للقانون ولأ داب وأعراف المهنة وهذا ما يسمى بالمنافسة غير المشروعة. ولذا كرس المشرع الجزائري ومن خلال الأمر 03/03 المعدل والمتمم والمتعلق بالمنافسة و أيضا القانون رقم 02/04 المعدل والمتمم الذي يحدد القواعد المطبقة على الممارسات التجارية، أن التجار لهم الحق في اللجوء إلى القضاء لحماية نشاطهم التجاري، وهو ما يعرف بدعوى المنافسة غير المشروعة والتي هي وسيلة يلجأ إليها المدعي يطلب فيها التعويض عن الضرر الذي لحق به جراء أعمال المنافسة غير المشروعة ووقف العمل غير المشروع، وتستند هذه الدعوى الى قواعد المسؤولية التقصيرية الخطأ، الضرر، العلاقة السببية ويتم ذلك عن طريق الجهات القضائية .
Summary:
Competition is necessary and obligatory for the course of economic activity, but it may turn and become a burden on trade and on the merchant when illegal means are used in violation of the law and the ethics and norms of the profession, and this is what is called unfair competition.
Therefore, the Algerian legislator, through Ordinance 03/03 amended and supplemented and related to competition, as well as Law No. 02/04, amended and supplemented, which defines the rules applicable to commercial practices, established that traders have the right to resort to the judiciary to protect their commercial activity, which is known as the claim of unfair competition. Which is a means resorted to by the plaintiff in which he requests compensation for the damage he sustained as a result of the acts of unfair competition and the cessation of the unlawful act.).
