    الحماية الجزائية للتنوع البيولوجي في التشريع الجزائري

    تعالج هذه المذكرة موضوع الحماية الجزائية للتنوع البيولوجي في الجزائر، بوصفه ركيزة أساسية لتحقيق التوازن البيئي وضمان استدامة الموارد الطبيعية. وقد خُصص الفصل الأول لتأصيل الإطار المفاهيمي للتنوع البيولوجي، من خلال تعريفه وبيان أنواعه ومظاهره، وكذلك إبراز أهميته في حفظ النظم البيئية وتعزيز الأمن الغذائي والاقتصادي. كما تم تحليل واقع التنوع البيولوجي في الجزائر، والتحديات التي تهدده، لا سيما الأنشطة البشرية الجائرة والتغيرات المناخية. أما الفصل الثاني، فتناول الآليات الجزائية المعتمدة لحماية هذا المكون الحيوي، سواء على المستوى الإجرائي (مرحلة ما قبل المحاكمة والمحاكمة) أو الموضوعي، من خلال دراسة أركان الجريمة البيئية. وخلصت الدراسة إلى تقييم مدى نجاعة الإطار التشريعي الوطني، مع تقديم مقترحات لتعزيز الحماية بما ينسجم مع الالتزامات الدولية. Abstract: This dissertation addresses the issue of criminal protection of biodiversity in Algeria, recognizing it as a fundamental pillar for environmental balance and the sustainable use of natural resources. The first chapter establishes the conceptual framework of biodiversity by defining it, identifying its types and manifestations, and emphasizing its vital role in maintaining ecosystems and promoting food and economic security. It further analyzes the state of biodiversity in Algeria and the threats it faces, particularly those stemming from unsustainable human activities and climate change. The second chapter examines the criminal mechanisms adopted for its protection, both procedurally (pre-trial and trial phases) and substantively, through a detailed study of the legal elements of environmental offenses. The study concludes by assessing the effectiveness of Algeria’s legal framework and proposing recommendations to reinforce biodiversity protection in line with international obligations.
