    ملخص لقد تطورت الجرائم تكنولوجيات الإعلام والاتصال في العصرالحديث تطوراملحوظ اسواء في أشخاص مرتكبيها أوفي أسلوب إرتكابها وذلك باستخدام أخرما ت وصلتإليهالعلومالتقنيةوالتكنولوجية،ولماكانتهذهالجرائمحديثةالنشأةلتعلقهابتكنولوجيا. المعالجةالآليةللمعلوماتفقداكتنفهاالغموضبالشكلالذيدعاإلىالقولبأنلاوجودلهاوأنهلايوجدأي تهديدحقيقيمنبعهالحاسباتالإلكترونية،وإنكانهناكأشكالللسلوكغيرالمشروعالذييرتبطبالمجالاتالإلكترونيةفهيجرائمعاديةيمكنتطبيقالنصوصالجزائيةالتقليديةبشأنها. انتطبيقالنصوصالتقليديةعلىهذهالأنماطالمستحدثةمنالجرائمقدأسفرعنالكثيرمنالمشكلاتالقانونية،وقدتضاربتأحكامالقضاءمنهامنطبقتأحكامالنصوصالتقليديةعلىأيسلوكيتعلقبنظممعالجةالمعلومات،ومنهامنرأتأنهسلوكامباحالميردبشأنهنصيجرمهالتزامابمبدأالشرعيةالجزائيةوالذييقضيبأن) لاجريمةولاعقوبةالابنص. ( abstract In the last years, the world witnessed a big development in the crimes of technology and communication. Criminals use new and advanced methods in the electronic and technology science by, the way many opinions and doubts about these crimes because there are no real menace and threatening. However, if there are kinds and types of behavior related to electronic Field means are normal crimes should apply the penal law on them. The application of ancient articles on these new types of crimes brought plenty of problems in law. There are different sanctions applied by the ancient penal, articles related to the system of information treatment, in other way law must be applied, due to there is no crime, without sanctions. The creation of economical and financial pole and Cyber pole else in this last period decreased huge role of competent authoroties which made its role narrow and leave the main role for the cyber Pole instead the ancient competent authoroties because of the developped materials and capacities that push it to face and fight these crimes.
