    النظام القانوني للسياحة والتنمية المستدامة في الجزائر

    تناولت هذه الدراسة "النظام القانوني للسياحة والتنمية المستدامة في الجزائر" بهدف تقييم مدى فعالية الإطار القانوني والمؤسساتي في تحقيق التوازن بين متطلبات الاستثمار السياحي وحماية الموارد الطبيعية والثقافية، حيث اعتمدت الدراسة المنهج التحليلي والوصفي مع إشارة مقارنة محدودة للتجارب الفرنسية والتونسية والمصرية، وتوصلت الدراسة إلى أن المنظومة القانونية الجزائرية متكاملة نسبياً من حيث تكريس المبادئ والآليات، لاسيما من خلال القانون 01-03 والقانون 03-03 والقانون 03-10 والمخطط التوجيهي للتهيئة السياحية SDAT 2030، غير أن الدراسة كشفت عن فجوة بين النصوص القانونية والتطبيق الميداني، وضعف التنسيق المؤسساتي، وندرة البيانات الإحصائية، وأوصت الدراسة بمراجعة النصوص القانونية، وإنشاء قاعدة بيانات وطنية رقمية للعقار السياحي، وتعزيز آليات الرقابة البيئية. ا Study Summary: This study examined "The Legal System of Tourism and Sustainable Development in Algeria" with the aim of assessing the effectiveness of the legal and institutional framework in achieving a balance between the requirements of tourism investment and the protection of natural and cultural resources. The study adopted an analytical and descriptive approach, with a limited comparative reference to the French, Tunisian, and Egyptian experiences. The study concluded that the Algerian legal system is relatively integrated in terms of enshrining principles and mechanisms, particularly through Law 03-01, Law 03-03, Law 03-10, and the SDAT 2030 Master Plan for Tourism Development. However, the study revealed a gap between legal texts and field application, weak institutional coordination, and a scarcity of statistical data. The study recommended revising legal texts, establishing a national digital database for tourism property, and strengthening environmental monitoring mechanisms.
