    تحديات المشاركة في الانتخابات المحلية وتأثيرها في تركيبة المجلس المنتخب

    تتناول هذه المذكرة موضوع "تحديات المشاركة في الانتخابات المحلية وتأثيرها على تشكلات المجالس المنتخبة"، وذلك في إطار استكمال متطلبات الحصول على شهادة الماستر في القانون الإداري. تعد االنتخابات المحلية البنية الاولى لبناء الديمقراطية من القاعدة إلى القمة، وتعتبر المجالس المنتخبة المحلية تجسيدا الالمركزية في التسيير. وقد كرس الدستور والقوانين الجزائرية هذه المبادئ، حيث نص الدستور ً لمبدأ على أن المجلس المنتخب يمثل مكان مشاركة المواطنين في تسيير الشؤون العمومية المحلية. الى أن واقع الممارسة الانتخابية في الجزائر يكشف عن أزمة مشاركة حادة، حيث لم تتجاوز نسب المشاركة في انتخابات 27 نوفمبر 2021 نسبة 97.35 %في المجالس البلدية و39.34 %في المجالس الوالئية. ويعود هذا العزوف إلى عوامل متعددة، تشمل عوامل اقتصادية واجتماعية، وسياسية ومؤسساتية، وثقافية ونفسية. وقد توصلت الد ارسة إلى أن هذه التحديات تؤثر سلبا ت المجالس المنتخبة، من حيث إضعاف ً على تشكال عاقة أدائها لمهامها الرقابية شرعيتها وتمثيليتها، والحد من قوتها الفعلية، والتأثير على هيكلتها وتوزيع مقاعدها، وا والتنموية . وخلصت الد ارسة إلى مجموعة من التوصيات، تشمل تعديل النظام الانتخابي، وتعزيز آليات الرقابة والطعون االنتخابية، وتفعيل دور المجتمع المدني، وتنظيم حمالت تحسيسية بأهمية المشاركة االنتخابية. الكلمات المفتاحية: االنتخابات المحلية، المجالس المنتخبة، تحديات المشاركة، العزوف الانتخابي، الجزائر،القانون الاداري. Abstract (in English) This dissertation addresses the topic of "Challenges of Participation in Local Elections and Their Impact on the Formation of Elected Councils," as part of the requirements for obtaining a Master's degree in Administrative Law. Local elections are the cornerstone for building democracy from the grassroots up, and elected local councils represent the embodiment of the principle of decentralization in governance. The Algerian constitution and laws have enshrined these principles, stipulating that the elected council represents a place for citizen participation in the management of local public affairs. However, the reality of electoral practice in Algeria reveals a severe participation crisis, with participation rates in the elections of November 27, 2021, not exceeding 35.97% for municipal councils and 34.39% for provincial councils. This abstention is attributed to multiple factors, including economic and social factors, political and institutional factors, and cultural and psychological factors. The study found that these challenges negatively affect the formation of elected councils, by weakening their legitimacy and representativeness, limiting their actual power, affecting their structure and seat distribution, and hindering their performance of supervisory and developmental tasks. The study concluded with a set of recommendations, including amending the electoral system, strengthening oversight and electoral appeal mechanisms, activating the role of civil society, and organizing awareness campaigns on the importance of electoral participation.
