    التراخيص الإدارية كآلية لتنظيم النشاط السياسي في الجزائر

    تتناول هذه الدراسة موضوع الرخص الإدارية كآلية قانونية لتنظيم النشاط السياحي في الجزائر، من خلال تحليل إطارها المفاهيمي ونظامها القانوني. وتبرز أهمية هذا النظام في تحقيق التوازن بين حرية الاستثمار ومتطلبات حماية المصلحة العامة. كما توضح الدراسة دور الإدارة في فرض رقابة مسبقة ولاحقة لضمان احترام القوانين وتحسين جودة الخدمات السياحية. وتبين أن الرخص الإدارية تخضع لسلطة تقديرية مقيدة بشروط قانونية تهدف إلى حماية النظام العام. كما تكشف عن وجود صعوبات تتعلق بتعقيد الإجراءات وتعدد النصوص القانونية. وتخلص الدراسة إلى ضرورة إصلاح النظام من خلال تبسيط الإجراءات وتعزيز الرقمنة لتحقيق فعالية أكبر في تنظيم القطاع السياحي. Abstract: This study examines administrative licenses as a legal mechanism for regulating tourism activities in Algeria by analyzing their conceptual and legal framework. It highlights their importance in balancing investment freedom with the protection of public interest. The study also explains the role of administration in ensuring prior and subsequent control to maintain legal compliance and service quality. It shows that administrative licenses are subject to discretionary power governed by legal conditions to safeguard public order. The research identifies challenges such as procedural complexity and the multiplicity of legal texts. It concludes by recommending reforms, including simplifying procedures and adopting digitalization to enhance the efficiency of tourism sector regulation.
