    المسؤولية الإدارية عن أعمال مرفق الشرطة

    ترتكز هذه الدراسة على المسؤولية الإدارية عن أعمال مرفق الشرطة حيث تم في الفصل الأول تناول الجوانب النظرية للمسؤولية الإدارية من حيث مفهوما وأنواعها وشروط قيامها، والقواعد المنظمة لعمل مرفق الشرطة والضوابط التنظيمية التي تحكم نشاط الشرطي في إطار حفظ النظام العام، بينما خصصنا الفصل الثاني للأسس القانونية التي تقوم عليها هذه المسؤولية سواء على أساس الخطأ كقاعدة عامة، أو بدون خطأ (نظرية المخاطر، الإخلال بمبدأ المساواة أمام الأعباء العامة) استثناء على القاعدة العامة، كما أبرزت الدراسة دور القضاء الإداري في تكريس حماية حقوق الأفراد من تجاوزات مرفق الشرطة ،وتناولت كذلك الآليات القانونية المعتمدة لضمان التوازن بين متطلبات النظام العام واحترام الحريات وتعزيز الرقابة القضائية، لضمان فعالية المسؤولية الإدارية عن اعمال مرفق الشرطة، وتقرير التعويض، وتكريس سيادة القانون. Abstract: This study examines administrative liability for the acts of the police service. The first chapter addresses the theoretical framework of administrative liability, including its concept, types, and the conditions required for its establishment. It also analyzes the legal rules governing the operation of the police service and the regulatory constraints that shape police activity within the context of maintaining public order. The second chapter is devoted to the legal foundations upon which such liability is based, whether grounded in fault as the general rule, or established without fault—namely under the risk theory and the breach of the principle of equality before public burdens—as exceptions to the general rule. Furthermore, the study highlights the role of the administrative judiciary in safeguarding individuals’ rights against abuses by the police service. It also examines the legal mechanisms adopted to ensure a balance between the requirements of public order and the protection of fundamental freedoms, as well as the strengthening of judicial oversight to guarantee the effectiveness of administrative liability for police activities, the awarding of compensation, and the consolidation of the rule of law.
