Abstract
ملخص:
يعتبر النظام التأديبي للموظف العام في التشريع الجزائري ذا أهمية بالغة في تنظيم الوظيفة العمومية، إذ يتضمن هذا النظام مجموعة من القوانين واللوائح التنظيمية التي تضبط سلوك الموظفين العامين وتحدد الإجراءات الخاصة بتطبيق العقوبات عليهم في حالة مخالفة القوانين والأنظمة، ما يجعلهم عرضة للمسألة التأديبية وتوقيع عقوبة تأديبية، توقعها السلطة المختصة بالتأديب وفق إجراءات تأديبية حددها ونظمها المشرع الجزائري من خلال الأمر 06-03 المتضمن القانون الأساسي العام للوظيفة العمومية، وهذا ما يضمن فاعلية الإدارة وحسن سير مختلف أجهزتها الوظفية، ولضمان التوازن بين الإدارة والموظف العام، حرص المشرع الجزائري على توفير مجموعة من الضمانات التي ترافق سير الإجراءات التأديبية للموظف العام، تضمن له حقوقه وتحميه من تعسف الإدارة والاستخدام السيء لسلطتها.
Summary:
The public official's disciplinary system in Algerian legislation is crucial to the organization of the public service. The Act contains a set of laws and regulations governing the conduct of public officials and establishing procedures for the application of penalties against them in the event of a violation of laws and regulations; This makes them liable to disciplinary matters and the imposition of a disciplinary penalty, which is expected by the competent disciplinary authority in accordance with disciplinary procedures established and regulated by the Algerian legislature through Ordinance No. 06-03 containing the General Basic Law on Public Employment and this ensures the effectiveness of the Department and the proper functioning of its various functional organs, In order to ensure a balance between the Department and the Public Servant, the Algerian legislator ensured that a set of safeguards was provided to accompany the conduct of the Public Servant's disciplinary proceedings. guarantees his rights and protects him from the arbitrariness of the administration and the abuse of its authority.
