Abstract
إن أساس العقد وجوهره هو تلاقي إرادة المتعاقدين، ومن هذا التلاقي ينشأ ما يسمى بالتراضي الذي يمثل أساس كل اتفاق ،كما أن تحديد محتوى العقد و تعديله وإنهائه مراده في أغلب الاحيان إلى إرادة طرفيه ، ولقد تدخل المشرع في توجيه هذه الإرادة بالقدر الذي يسمح بضمان الاستقرار في المركز القانوني وإحداث التوازن في العقد وكذا حماية الإرادة ذاتها لما لها من دور في المجال التعاقدي .
Summary
it the basis and essence of the contract is the convergence of the contracting parties, and from this convergence arises what is called mutual consort , which represents the basis of every agreement ,just as the determination of the contract and its termination is most often determined by the will of the two parties ,and the legislator has intervened in directing this will to the extent that allows ensuring stability in the legal status and balance in the Cori tract ,as well as the protection of the will itself because of its role in the contractual field
