Abstract
الملخص
يعد موضوع السر الطبي موضوع بالغ الأهمية في الدراسات القانونية التي تهتم بمعالجة موضوع مهم متعلق بالمريض وضرورة المحافظة على أسراره من قبل الطبيب ومساعديه وهذا الالتزام يرد عليه بعض الاستثناءات المقررة للمصلحة العامة دون أن يعتبر الطبيب محل بالتزامه كالإبلاغ عن المواليد والوفيات والأمراض المعدية والتي تشكل خطر على المصلحة العامة ولا يعتبر الطبيب مسؤولا في هذه الحالات؛ ولكن عند كشف الأسرار التي لا تندرج ضمن الحالات والاستثناءات الواردة يعتبر الطبيب تحت واقعة الإخلال بالالتزام العام بسر الطبي وتقوم عليه مسؤولية مدنية وجزائية لإفشائه بسر من الأسرار التي لا ينبغي عليه كشفها وتفرض عليه عقوبات حسب قانون العقوبات الجزائري.
Summary
The topic of medical secret is a very important topic in legal studies that are concerned with dealing with an important issue related to the patient and the necessity of preserving his secrets by the doctor and his assistants. public interest and the doctor is not considered responsible in these cases; However, when revealing secrets that do not fall within the cases and exceptions mentioned, the doctor is considered under the incident of breaching the general commîtes to a médical secret, and he is liable for his disclosure of a secret that he should not dis close, and penalties are imposed on him accordions to the Algérien Pénal Code.
