ملخص
أخذت المضاربة غير المشروعة معدلات مرتفعة ، خاصة خلال جائحة كرونا والتي تزامنت مع مرور أغلب دول العالم بأزمة اقتصادية حادة ، استدعى هذا الوضع من المشرع الجزائري التدخل بحزم وشدة ، وهذا ما تجسد فعلا من خلال صدور القانون ( 21-15) المؤرخ في 28/12/2021 ، المتعلق بمكافحة المضاربة غير المشروعة والذي تناولنا من خلاله موضوع بحثنا هذا ،حيث شملت دراسته فصلين أحدهما تضمن الجانب المفاهيمي وكل ما ينطوي تحته من تعريفات للمضاربة غير المشروعة ، صورها، أسبابها وكذا أركان هذه الجريمة والعقوبات المقررة لها بالإضافة إلى فصل ثاني إحتوى على الإطار الإجرائي للمتابعة في جرائم المضاربة غير المشروعة و مختلف الآليات لمجابهة هذه الجريمة.
Abstract
During the Corona pandemic, illegal speculation took a high rate when most countries of the world have gone through a severe economic crisis. Thus, the Algerian legislator required an intervention to abrupt the situation through the promulgation of (15-21) law on 28/12/2021, related to fight against illegal speculation. In the following study, we deal with two chapters one dealt with the conceptual framework including definition, facets, causes, types, and legal sanctions. In addition to that, the second chapter dealt with the procedural framework to follow and penalize illegal speculation as well as the various mechanisms to stand against this crime
