Abstract
هذا البحث عبارة عن دراسة تحليلية مقارنة بين الشريعة الإسلامية و القانون الجنائي الجزائري حول جرائم الحدود وعقوباتها ولقد تعرضت من خلال هذا البحث المتواضع لتعريف الجريمة وأركانها وكذا أساس التجريم ومبدأشرعية الجرائم في الشريعة الإسلامية والقانون الجنائي الجزائري
ثم تعرضت لتقسيمات الجريمة وتصنيفاتها في الشريعة الإسلامية و التشريع الجزائري وقارنت بينهما ثم بعذ ذلك ذكرت خصائص جرائم الحدود وذكرت مالايدخل ضمن نطاق هذه الجرائم بعد ذلك تكلمت بالتفصيل عن جرائم الحدود والعقوبة المقررة لكل جريمة وقارنت بين الشريعة الإسلامية والتشريع الجزائري في العقوبات المترتبة عن هذه الجرائم و حكم العفو عنها
فهدف هذه الدراسة هو الإحاطة الكاملة بالجانب النظري والتطبيقي لجرائم الحدود ومقارنة هذه الجرائم بين الشريعة الإسلامية والتشريع الجزائري حيث نجد أن الشريعة الإسلامية عالجت هذه الجرائم بكفاءة وإعتدال في حين أن التشريع الجزائري لم يعرج عليها بشكل خاص وهذا ماساهم في إنتشارها لحد الأن
This research is a comparative analytical study between Islamic law and Algerian criminal law on hudud crimes and their penalties. Through this modest research, I dealt with the definition of crime and its elements as well as the basis of criminalisation and the principle of the legality of crimes in Islamic law and Algerian criminal law.
After that, I mentioned the characteristics of hudud offences and mentioned what does not fall within the scope of these offences. After that, I spoke in detail about hudud offences and the prescribed punishment for each offence and compared between Islamic Sharia and Algerian legislation in the penalties resulting from these offences and the provision of amnesty for them, in addition to a comparison between Islamic Sharia and Algerian legislation.
The aim of this study is to fully understand the theoretical and practical aspect of hudud offences and to compare these offences between Islamic law and Algerian legislation, as we find that Islamic law has dealt with these offences efficiently and moderately, while Algerian legislation has not specifically addressed them and this has contributed to their proliferation until now
