Abstract
الملخص
بصدور المرسوم التنفيذي رقــم: 90-405، المـؤرخ فـي 22 ديسمبر 1990، الذي أعلن انشاء الوكالات المحلية للتسيير والتنظيم العقاري والذي أعقبه المرسوم التنفيذي رقم: 03-408، المؤرخ في: 05 نوفمبر 2003، يعدل ويتمم المرسوم السالف الذكر، يتم بموجبه إنشاء وكالات الولائية للتسيير والتنظيم العقاريين الحضريين كمؤسسة تقوم بدور المهيأ والمرقي لصالح الهيئات العمومية وكذا لصالحها الخاص والتنازل عنها، إذن فهي مرقي عقاري عمومي، تساهم في نشاطات الترقية العقارية و كذا الأعمال التجارية المرتبطة بهذا النشاط . اخترنا موضوع مساهمة هاته الهيئات في مجال الترقية العقارية وتدخلاتها، غير أنه بالنظر للاعباء الموروثة عن الوكالات المحلية ما بين البلديات من جهة وسوء التسيير لبعض المسييرين من جهة اخرى قلص من مردوديتها في هذا المجال واقتصرها دورها فقط على تسوية بعض الوضعيات السابقة في تسييرها للمحفظة العقارية البلدية، معتمدين في ذلك على المنجهين الوصفي والتحليلي في موضوع دراستنا.
Abstract:
With the promulgation of Executive Decree No. 90-405 on December 22, 1990, announcing the establishment of local agencies for land management and organization, followed by Executive Decree No. 03-408 on November 5, 2003, amending and supplementing the aforementioned decree, urban land management and organization agencies were established at the wilaya level as institutions responsible for development and real estate promotion for public bodies and for their own account. These agencies are therefore public real estate developers, contributing to real estate promotion activities and associated commercial transactions.
We have chosen to address the subject of the contribution of these organizations to real estate development and their interventions in this field. However, due to the charges inherited from inter-communal agencies on the one hand, and the poor management of some officials on the other, their performance in this area has been reduced and their role has been limited to regularizing certain past situations in the management of the communal land portfolio. Our study on this subject adopts a descriptive and analytical approach.
