الملـــــــخص
نظرا لبطى عملية مسح الأراضي من جهة والتي استغرقت مدة أطول وكذا السلبيات المترتبة عن العمل بعقد الشهرة من جهة ثانية، ساهم في اختلال التوازن العقاري والعشوائية في وضعية العقارات خاصة وأنها مست الأملاك الوطنية والوقفية الشي الذي زاد من حدة المنازعات فاستدعت الضرورة لإيجاد حلول قانونية تضبط المجال العقاري والتصرفات العقارية الواردة عنه جعل المشرع الجزائري يسن قانون 07/02 المؤرخ في: 27/02/2007 المتضمن تأسيس إجراء لمعاينة حق الملكية العقارية وتسليم سندات الملكية ومرسومه التنفيذي 08/147 المتعلق بعمليات سير التحقيق العقاري.
وتتضمن آلية التحقيق العقاري مجموعة من الإجراءات القانونية والإدارية والميدانية بالإشراف من مديرية الحفظ العقاري التي تعين محقق عقاري لمباشرة الإجراءات ميدانيا والتأكد من وقائع الحيازة وتوفر شروطها القانونية بغرض إعداد وتسليم سند الملكية، بعد مطابقة النتائج، وقد تنجم عنه منازعات قضائية تتعلق بالترقيم والتأشير على البطاقات العقارية، كما وقد تترتب احتجاجات واعتراضات يتم الفصل فيها أمام جهات القضاء العادي أو القضاء الإداري.
Summary:
It Added to the real estate imbalance and ranommess of the situation because of the slowness of the land surveying process, which took longer, andthe drawbacks of working with the goodwill contact, this was especially true since it affected national and endowment properties, which intensified the disputes and made legal solutions necessary.
The Algerian legislator passed Law 07/02, dated 27/022007/, to regulate the real estate industry and the related transactions, it established a process for examining the right to real estate ownership and transferring title deeds, and Italso issued Executive Decree 08/147 to oversee the real estate investigation process.
The real estate conservation Directorate oversee a set of legal administrative , and field procedures that make up the real estate investigation mechanism it designates a real estate investigator to start fieldwork and confirm possession facts and availability of related legal conditions in order to prepare and deliver the title deed once the results match, judicial conflicts over notation and numbering may from this card for real estate, it is also possible for protests and complaints to arise, which are resolved by the administrative judiciary or ordinary judicial authorities .
