Abstract
ملخص:
يعد الاشتراط في عقد الزواج أمر جائز قانونا وشرعا، يخضع لإرادة الزوجين واختيارهما، إذ يحق لهما سواء في الفقه الإسلامي أو في قانون الأسرة الجزائري أن يشترطا كل الشروط التي يريانها ضرورية، غير أن هذا الحق مقيد بضوابط قانونية أهمها عدم مخالفة هذه الشروط في العقد لقواعد قانون الأسرة وكذا عدم مخالفتها للنظام العام والآداب العامة.
أما الفقه الإسلامي فقد قيد الاشتراط بضابط أساسي وهو أن يكون متماشيا مع مقتضيات عقد الزواج وإلا اعتبر باطلا، بينما رتب لها قانون الأسرة جزاءين، الجزء الأول إبطال عقد الزواج إذا كان الشرط يتنافى ومقتضيات العقد، أما الجزء الثاني اعتبر الشرط باطلا والعقد صحيحا.
وان التشريع الأسري الجزائري قد أكد على أحقية الاشتراط في عقد الزواج أو في عقد رسمي لاحق مع إعطاء مثالين حاول من خلالهما حماية حق المرأة في العمل، وفي عدم التعدد عليها دون رضاها كما أن لها الحق في طلب الفسخ عند عدم الوفاء لها بالشرط.
Abstract:
The stipulation in the marrigecontract is legally permissible ,it is Subject to the management and Selection of the spouses wether in Islamic jurisprudence or in Algerian family law , spouses are entitled to stipulate alle the conditions they seem necessary. Hawever this right is restricted by legal controls the most important of which is that these conditions in the contract do not violate the rules of family law and thy also don't violate public order and public morals.
As for Islamic jurisprudence,it restricted the condition to a basic condition, wich is that it be consistent with the requirements of the marriage contract otherwise it will be considered invalid, while family law stipulates two penalties for it the first part is invalidation of the marriage contract if the condition contradicts the requirements of the contract. The second part considers the condition in valid and contract valid.
Algerian family legislation has emphasized the right of the condition in the marriage contract or in Amy subsequent officialcontract, with two escomples through which it tried to protect the woman's right to work and not have more than one wife " polygamy " without her acceptance. Shealso has the right to request annulment when the condition is not fulfilled.
