Abstract
ملخص المذكرة:
تعد براءة الاختراع من أهم عناصر الملكية الصناعية ونظرا لأهميتها اهتمت أغلب الدول بتنظيمها قانونيا ومن بينها الجزائر .
ومن خلال دراستنا هذه تطرقتا إلى الحماية القانونية لبراءة الاختراع في التشريع الجزائري حيث سلطنا الضوء على أهم الجوانب المتعلقة بها ، ذلك بتقسيم الدراسة إلي فصلين تعرضنا في الفصل الأول إلى التعريف المفاهيمي لبراءة الاختراع بينما الفصل الثاني خصصناه لدراسة آليات الحماية القانونية لبراءة الاختراع في التشريع الجزائري سواء كانت الحماية داخلية أو خارجية ،كما أتبعنا في هذه الدراسة منهجيين ذلك للإلمام بكافة عناصر الموضوع المنهج التحليلي من خلا تحليل مختلف الإحكام والنصوص التي جاءت بها مختلف الاتفاقيات المبرمة والمنهج الوصفي من خلال وصف الأحكام القانونية التي لها علاقة بالموضوع .
وختاما تعرضتا إلى جملة من النتائج و التوصيات التي نأمل أن يكون لها أثر على المنظمة القانونية في التشريع الجزائري .
Summary:
The patent is one of the most important elements of industrial property, and due to its importance, most countries have taken an interest in regulating it legally, including Algeria. Through this study, we touched on the legal protection of the patent in Algerian legislation, where we shed light on the most important aspects related to it, by dividing the study into two chapters. We presented in The first chapter covers the conceptual framework of the patent, while the second chapter is devoted to studying the mechanisms of legal protection for the patent in Algerian legislation, whether the protection is internal or external In this study, we also followed two methodologies in order to gain familiarity with all the elements of the subject, the analytical approach through analyzing the various provisions and texts contained in the various concluded agreements, and the descriptive approach through describing the legal provisions that are related to the subject, and in conclusion, we presented a number of results and suggestions, which we hope will It will have an impact on the legal organization in Algerian legislation.
