Abstract
لطالما اهتم المجتمع الدولي بموضوع البيئة باعتباره أحد ركائز حقوق الإنسان لكن حمايتها كانت و لا زالت محل اختلاف نظرا للزمان و المكان الذي وقع فيه الاعتداء عليها فهذا الأخير نظرا لو وقع زمن النزاع المسلح مثلا فقد يكون للقانون وقفه أخرى و هي السكوت و للسلاح التكلم ، و على الرغم من هذا الظرف إلا أن مساعي المجتمع الدولي و القضاء الجنائي لضمان حماية البيئة أثناء النزاعات المسلحة يسعى جاهدا لإعطاء صفة التجريم للمخالفين و معاقبة المنتهكين خلال وسائل الحماية لاسيما في الوضع الحالي و الفترة الأخيرة لما يشهده العالم من حروب ،و نزاعات لكن يبقى الطريق طويلا لدفع احترام حماية البيئة أثناء النزاعات المسلحة إلى المستوى المرجوا و المطلوب عالميا .
The international community has long been concerned with environmental issues, considering them one of the pillars of human rights. However, protecting the environment has always been a matter of contention, depending on the time and place where the violation occurred. For instance, if the violation happens during armed conflicts, the law may remain silent while weapons speak. Despite this challenging context, the international community and criminal justice systems strive to ensure environmental protection during armed conflicts by criminalizing offenders and punishing violators. This is achieved through issuing deterrent rules and regulations and enhancing protection mechanisms, especially given the recent period and the numerous wars and conflicts witnessed worldwide. Nevertheless, we still have a long way to go to advance the respect for environmental protection during armed conflicts.
