| dc.description.abstract | ملخص المذكرة: يعتبر عقد الفرانشيز وسيلة من وسائل الإستثمار الحديثة التي أنشأها التعامل التجاري ، إذ هو عقد يجمع بين طياته خصائص العديد من العقود ، لكنه يستقل عنها و لا يمكن إضفاء طابع أي منها على هذا العقد ، كما أنه يتمتع بخاصية الإستثمار الفكري و الشبكة اللتان تسهمان في إبراز طبيعته الخاصة ، كما يترتب عليه آثار بالنسبة للمانح و الممنوح له ، قد ينتهي عقد الفرانشيز في طور تنفيذه إما بوفاة أحد الأطراف المتعاقدة أو بتصفية الأموال ، و أيضا ينقضي في حالة الفسخ و إبطال العقد ، و ينتهي كذلك بإنتهاء أجله سواء كان محدد أو غير محدد ، و بمجرد إنقضائه يترتب عليه آثار لكلا الطرفين في العقد. Memo Summary: The franchise contract is considered a modern investment tool created by commercial transactions. It combines the characteristics of many contracts, but is independent of them and cannot be attributed to any of them. It also pos-sesses the characteristics of intellectual investment and networking, which con-tribute to its unique nature. It also has consequences for the franchisee and the franchisee. The franchise contract may end during its implementation, either by the death of one of the contracting parties or by the liquidation of the assets. It also ends in the event of termination and annulment of the contract, and it also ends with the expiration of its term, whether it is fixed or indefinite. Once it expires, it has consequences for both parties to the contract. | |
