dc.description.abstractإذا كان مفهوم دولة القانون والمؤسسات يرمز الى ذلك النظام المؤسسي الذي تكون فيه السلطات العامة مقيدة بالقانون في ممارسة سلطتها، فدولة القانون بعبارة أخرى هي تلك الدولة التي يسمو فيها القانون ومحاربة الفساد، وتكون القواعد القانونية فيها متدرجة على شكل هرمي، بحيث تستمد كل قاعدة صحتها من القاعدة الأسمى منها درجة. ومنه وفي إطار إتباع سياسة وطنية شاملة لمكافحة الفساد، استحدثت المشرع الجزائري الهيئة العليا للشفافية ومكافحة الفساد بموجب القانون رقم 06-01 المتعلق بالوقاية من الفساد ومكافحته المعدل والمتمم سنة 2022، حيث تعتبر هذه الهيئة آلية من الآليات القانونية المتخصصة وقائيا وردعيا للحد من الجرائم الفساد. If the concept of the state of law and institutions symbolizes that institutional system in which public authorities are restricted by law in exercising their authority, then the state of law, in other words, is that state in which the law and the fight against corruption prevail, and in which the legal rules are hierarchically graded, so that each rule derives its validity. Of the rule of the highest degree. also, within the framework of following a comprehensive national anti-corruption policy, the Algerian legislator established the High Authority for Transparency and Anti-Corruption in accordance with Law No. 06-01 on the Prevention and Combating of Corruption, amended and supplemented in 2022, as this authority is considered one of the specialized legal mechanisms for prevention and deterrence in reducing Corruption crimes.
