| dc.description.abstract | تمحورت الدراسة الحالية حول حماية المدنين أثناء النزاعات المسلحة من خلال تسليط الضوء على اتفاقية جنيف الرابعة المتضمنة حماية المدنين بالإضافة إلى القانون الإنساني الدولي.مع التعرف على دور الهيئات الدولية المكلفة بحماية المدنيين على غرار اللجنة الدولية للصليب الأحمر والمحكمة الجنائية الدولية ومجلس الأمن الدولي هذه الهيئات التي تسهر على احترام المدنين أثناء النزاعات المسلحة وفرض قراراتها على الأطراف المتنازعة غير أن هناك بعض الاختلالات في عمل هذه الهيئات حال دون تطبيق قراراتها مما أدى إلى ارتكاب إبادات جماعية وجرائم ضد الإنسانية.توصلت الدراسة إلى جملة من النتائج نستعرض أهمها كما يلي: +جاءت اتفاقية جنيف الرابعة لحماية المدنيين دون سواهم. +الفئات التي شملتها اتفاقية جنيف الرابعة هي (النساء الحوامل-الأطفال-الأسرى والجرحى) +رغم إنشاء المجتمع الدولي لهياكل ومؤسسات من أجل السهر على حماية المدنين إلا أنها هيكل بدون روح فهي مسلطة ضد الدول الفقيرة والضعيفة. 2- Abstract The current study focused on the protection of civilians during armed conflicts by highlighting the Fourth Geneva Convention, which includes the protection of civilians, in addition to international humanitarian law. It also identified the role of international bodies charged with protecting civilians, such as the International Committee of the Red Cross, the International Criminal Court, and the Security Council. International security bodies are responsible for ensuring respect for civilians during armed conflicts and for enforcing their decisions on the conflicting parties. However, there are some irregularities in the work of these bodies that have prevented the implementation of their decisions, leading to the commission of genocide and crimes against humanity. The study reached a number of conclusions, the most important of which are as follows: The Fourth Geneva Convention was designed to protect civilians exclusively. The categories covered by the Fourth Geneva Convention are (pregnant women, children, prisoners, and the wounded). Despite the international community's establishment of structures and institutions to ensure the protection of civilians, these structures are soulless and are directed against poor and weak countries. | |
