| dc.description.abstract | يعد موضوع الوساطة القضائية من أهم الموضوعات المستحدثة التي تناولها تعديل قانون الإجراءات الجزائية في الجزائر سنة 2015 ، ومنه تهدف هذه الدراسة الى بلورة مفهوم حول دور الوساطة القضائية والتي مؤداها ذلك العمل الذي يقوم به طرف ثالث يدعى الوسيط لمساعدة أطراف الخصومة أملا في التوصل إلى حل يرضاه طرفا النزاع ، بهدف الحفاظ على الروابط الاجتماعية و تحويل علاقة العمل الاتفاقي من التصادم بين الأطرافسواءا كان هذا التصادم نزاعا عمل فرديا او جماعيا إلى أسلوب تعاقدي يلتزم من خلاله اطراف اتفاقية العمل الى التوافق و التصالح بين العمال وارباب العمل. The subject of judicial mediation is one of the most important new topics addressed by amending the Code of Criminal Procedure in Algeria in 2015. This study aims to formulate a concept about the role of judicial mediation, which is the work carried out by a third party called the mediator to assist the parties to the dispute in the hope of reaching a solution that satisfies them. The two parties to the conflict, with the aim of preserving social ties and transforming the contractual labor relationship from a clash between the parties, whether this clash is an individual or collective labor dispute, to a contractual method through which the parties to the labor agreement commit to agreement and reconciliation between workers and employers. | |
