| dc.description.abstract | تهدف هذه الدراسة الموسومة بعنوانالتحقيق العقاري كآلية لتسوية سندات الملكية فيالقانون الجزائريإلى التعرف و الإحاطة بكل ما يتعلق بالتحقيق العقاري بدرجة أولى الذي يكتسب أهمية بالغة كونه آلية قانونية وإدارية تهدف إلى تنظيم الملكية العقارية، وتحديث السجلات وتسوية المنازعات المتعلقة بها، وضمان حقوق المالكين وانطلقت الدراسة من إشكالية مفادها : ما مدى فعالية التحقيق العقاري في تحقيق أهدافه المتمثلة في تنظيم الملكية العقارية، وتسوية المنازعات، وتحديث السجلات، وضمان حقوق المالكين في الجزائر؟ وتم الاعتماد في الدراسة على المنهج الوصفي والمنهج التحليلي لانهما يعتبران الأنسب لمثل هذه المواضيع وتم تقسيم البحث إلى فصلين اثنين الفصل الأول: ماهية التحقيق العقاري يتطرق إلى المدلولالقانونيوالفقهيللتحقيقالعقاري وأهدافالتحقيقالعقاريسيرعمليةالتحقيقالعقاري واما الفصل الثاني: الآليات الإجرائية في إصدار سند الملكية وفض منازعات التحقيق العقاري. وتوصلت الدراسة إلى نتائج : • يمثلالتحقيقالعقاريآليةأساسيةلتنظيمالملكيةالعقاريةفيالجزائر،ويهدفإلىمعالجةإشكالياتالماضي،وتحديثالسجلاتالعقارية،وتعزيزالأمنالقانونيوالاقتصادي. • يلعبالمحافظالعقاريدورًامحوريًافيعمليةالتحقيقمنخلالالإشرافعلـىالإجراءات،والتحققمنصحةالمستندات،وإصدارالقراراتالمتعلقةبالترقيم. • يتيحالقانونآلياتللطعنفيقراراتالترقيمأوالرفض،ممايضمنحمايةحقوقالأطرافالمتنازعة،ويخضععملالمحافظالعقاريللرقابةالقضائية،ممايعززالشفافيةوالمساءلة. This study, titled Real Estate investigation as a mechanism for settling property titles in Algerian law, aims to identify and take note of everything related to Real Estate investigation at the first degree, which is of great importance as it is a legal and administrative mechanism aimed at regulating real estate ownership, updating records and settling disputes related to them, and ensuring the rights of owners the study The study was based on the descriptive and analytical approach because they are considered the most appropriate for such topics and the research was divided into two chapters the first chapter: what is the real estate investigation touches on the legal and doctrinal meaning of the real estate investigation Chapter Two: procedural mechanisms in issuing the title deed and resolving disputes of the real estate investigation. The study reached the results of : * The real estate investigation is a basic mechanism for regulating real estate ownership in Algeria, and aims to address the problems of the past, Update real estate records, and enhance legal and economic security. * The real estate governor plays a pivotal role in the investigation process by supervising the procedures, verifying the authenticity of documents, and issuing decisions related to numbering. * The law provides mechanisms to appeal against numbering or rejection decisions, which ensures the protection of the rights of the disputing parties, and the work of the real estate governor is subject to judicial control, which enhances transparency and accountability | |
