Abstract

تناولت هذه الدراسة موضوع حماية المستهلك في عقود الجارة الإلكترونية، وذلك في ظل التوسع الكبير للمعاملات الرقمية وإنتشار منصات البيع عبر الإنترنت، مما أدى إلى ظهور تحديات تتعلق بالثقة والشفافية، وأمن البيانات وضمان حقوق الطرف الضعيف في العلاقة التعاقدية وهو المستهلك. كما تركز هذه الدراسة على إبرز الضمانات القانونية والتنظيمية التي وُضعت لحماية المستهلك أثناء تعامله عبر الوسائط الإلكترونية، مع توضيح مدى فعاليتها وحدودها في الواقع العملي، خصوصًا في القانون الجزائري. خلصت هذه الدراسة إلى أن المشرع الجزائري قطع خطوات مهمة نحو حماية المستهلك الإلكتروني، إلا أنه مازال بحلجة إلى إلى تعزيز وسائل الرقابة، وتطوير بنية الدفع الآمن، وتكثيف الوعي القانوني لدى المستهلك، كما أوصت بإننشاء منصات فعالة للشكاوى، وإعتماد شهادات أمن للمواقع وتطوير المنظومة القانونية الخاصة بحماية البيانات، إلى جانب تكوين القضاء في مجال النزاعات الرقمية. Summary This study dealt with the issue of consumer protection in electronic neighbour contracts, in light of the significant expansion of digital transactions and the spread of online sales platforms, which led to the emergence of challenges related to trust and secony, data security and ensuring the rights of the weak party in the contractual relationship, which is the consumer. This study also facusses on the legal and regulatory safeguards developed to protect the consumer during his dealings through electronic media, with an explanation in practice, especially in algerian law. This study concluded that the algerian legislator has taken impornt steps towards consumer protection for electonics, but he is still in need of strengthening the means of structure, and intensifying legal awareness among the consumer. It also recommended the establishment of effective complaint platforms, the adoption of security certificates for sites and the development of the legal system for data protection, to the judiciary in the field of didital disputes.

الكلمات المفتاحية:  التجارة الإلكترونية: هي مجموعة المعاملات التجارية التي تتم عبر الوسائط الإلكترونية وبالأخص شبكة الانترنت وتشمل بيع وشراء السلع والخدمات وتبادل المعلومات المالية والتعاقدية بين مختلف الأطراف بشكل غير حضوري.  المستهلك الإلكتروني: هو كل شخص طبيعي يقوم بإقتناء سلع أو خدمات عبر الأنترنت أو أي وسيلة إلكترونية أوخرى، وذلك لأغراض شخصية ، معتممدًا على المعلومات والعروض التي يقدمها المورد عبر الوسيط الرقمي.  حماية المستهلك: هي مجموعة القواعد القانونية والآليات التنضيمية التي تهدف إلى صون حقوق المستهلك وضمان حصوله عب السلع والخدمات بجودة وسلامة، ومنع استغلاله أو خداعه.  العقد الإلكتروني: هو إتفاق يتم بين طرفين عبر وسيلة إلكترونية، يُعبّر فيه عن الإيجاب والقبول بإستخدام تقنيات الإتصال الحديثة دون حضور مادي للطرفين.  الدفع الإلكتروني: عملية سداس ثمن سلعة أو حدمة عبر وسائل وتقنيات رقمية، مثل البطاقات البنكية، المحافظ الإلكترونية، التحويلات عبر الأنترنت، أو تطبيقات الدفع، دون استخدام النقود الورقية أو التعامل المباشر بين الطرفين.  عدم المطابقة: يشر إلى الحالة التي يحدث فيها اختلاف أو تعارض بين ما عرضه البائع وما إستلمه المستهلك في الواقع، سواء كان ذلك في المنتج أو الخدمة، أو في شروط العقد مما يشكل سببًا قانونيًا لحماية المستهلك.  المسؤولية المدنية: هي الإلتزام القانوني الذي يتسبب في ضرر للغير، بحيث يكون ملزمًا بالتعويض عن هذا الضرر.  القانون 18-05 : هو التشريع الجزائري الذي ينظم التجارة الإلكترونية ، ويحدد الإطار القانوني للعقود والمعاملات التجارية المنجزة عبر الوسائط الإلكترونية داخل الجزائر. It includes the buying and selling of goods and services, as well as the exchange of financial and contractual information between different parties with-out physical presence. • Electronic consumer: Any natural person who acquires goods or services via the Inter-net or any other electronic means for personal purposes, relying on the information and offers provided by the supplier through digital media. • Consumer protection: A set of legal rules and regulatory mechanisms aimed at safe-guarding consumer rights, ensuring access to goods and services of adequate quality and safety, and preventing exploitation or deception. • Electronic contract: An agreement concluded between two parties through an electron-ic means, in which offer and acceptance are expressed using modern communication technologies, without the physical presence of the parties. • Electronic payment: The process of paying the price of a good or service through digi-tal means and technologies, such as bank cards, electronic wallets, online transfers, or payment applications, without the use of cash or direct interaction between the parties. • Non-conformity: Refers to a situation in which there is a discrepancy or conflict be-tween what the seller offered and what the consumer actually received, whether in the product, the service, or the contractual terms, constituting a legal ground for consumer protection. • Civil liability: A legal obligation arising from causing harm to others, whereby the per-son responsible is required to compensate for the damage caused. • Law No. 18-05: The Algerian legislation that regulates e-commerce and defines the le-gal framework for contracts and commercial transactions carried out through electronic means within Algeria.
