    مسؤولية الطبيب عن الوصفة الطبية

    ملخص: إن المقصود بالمسؤولية المدنية للطبيب هو أي عمل إيجابي او سلبي يقوم به الطبيب قد يؤدي الى حدوث خطأ ينتج عنه ضرر يخالف النصوص والقوانين المنظمة لمهنة الطب يوجب من خلاله التعويض لمن أصابه الضرر. وهذا ما يرتب عليه التزا ل لايقع على عاتق الطبيب في معظم الحالات غالبا ما يكون التزامه ببذل عناية لا بتحقيق نتيجة إلا انه في بعض الحالات يجب ان يكون التزام الطبيب بتحقيق نتيجة كقيام الطبيب بإجراء العمليات التجميلية الحديثة التي تنطوي على خطورة أكبر وبالتالي فانه يجب ان تبذل بعناية خاصه ومشدده على خلاف الطبيب العادي. والاعن المسؤولية الجزائية للطبيب فيمكن مسائلته جزائياً عما يرتكبه من أخطاء وجرائم وذلك من خلال تحريره الوصفة الطبية فيرتكب فعل مخالفاً للقانون ويلحق ضرر بالمضرور، ويستدعي اتخاذ أكبر قدر ممكن من الحيطة والحذر وببذل العناية اللازمة اثناء تحريره لهذه الأخيرة. ولهذا يتوجب على الطبيب تحمل المسؤولية اثناء تحرير الوصفة الطيبة وذلك وفقاً للضوابط والشروط القانونية المخولة له قانون ا في مجال اختصاصه، كما القى هذا القانون الأخير على عاتق الطبيب التزامات يجب عليه احترامها ويترتب عن اخلاله لتلك القواعد قيام مسؤولية مدنية ومسؤولية جزئية. Summary: What is meant by the doctor’s civil liability is any positive or negative action performed by the doctor that may lead to an error resulting in damage that violates the texts and laws regulating the medical profession, through which compensation is required for those who sustained harm. However, in some cases, the doctor’s commitment must be to achieve a result, such as the doctor performing modern plastic surgeries that involve greater risk, and therefore it must be done carefully. Special and aggravating, unlike the regular doctor. As for the criminal responsibility of the doctor, he can be penally questioned for the mistakes and crimes he commits, by issuing a medical prescription, so he commits an act that violates the law and causes harm to the victim, and requires taking the greatest possible caution and caution, and he takes the necessary care while issuing the latter. Therefore, the doctor must bear the responsibility while issuing the good prescription, in accordance with the legal controls and conditions vested in him by law in his field of specialization.
