    ملخص الدراسة: تعتبر السرقة العلمية من الظواهر السلبية التي انتشرت في المؤسسات التعليمية على نحو ملفت للنظر خاصة عندما بلغت فئة نخبة المجتمع وهي المؤسسات الجامعية، هذه الأخيرة التي تشكل عصب المحيط الإجتماعي والإقتصادي لأنها توفر له مخرجاتها المتمثلة في الأبحاث والدراسات التي تعالج المشاكل التي تعاني منها ناهيك عن توفير اليد العاملة المؤهلة والمتخصصة. لأجل ذلك كان من الضروري وضع حد لها لحماية الفرد والمجتمع والدولة من آثارها الكارثية والمدمرة، وذلك من خلال الآليات الوقائية والردعية. Abstract: Plagiarism or plagiarized work is considered one of the negative phenomena that has spread in educational institutions in a striking manner, especially when it reaches the elite category of society, namely university institutions, the latter of which constitute the backbone of the social and economic environment because it provides it with its outputs represented in research and studies that address the problems it suffers from, not to mention providing qualified and specialized workforce. For this reason, it was necessary to put an end to it in order to protect the individual, society and state from its disastrous and destructive effects, through preventive and caring mechanisms.

    آليات المشرع الجزائري لمواجهة التمييز وخطاب الكراهية

    ملخص الدراسة: مع تزايد انتشار جريمة التمييز وخطاب الكراهية ، خاصة وبعد الوضع السياسي الذي عاشته الجزائر في السنوات الأخيرة والانفتاح الديمقراطي وانتشار وسائل التواصل الاجتماعي التي أصبحت بيئة مساعدة لانتشار التمييز وخطاب الكراهية، ما أصبح يهدد النظام العام. ولضمان عدم المساس بالوحدة الوطنية وممارسة الحريات الأساسية في شتى مجالات الحياة، أصدر المشرع نصوص قانونية تتضمن آليات للوقاية والحد من هذه الجريمة، فبعد دستور سنة 2020، جاء القانون 20-05 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما، الذي تضمن جملة من المبادئ العامة والإجراءات اللازمة للحد من هذه الجريمة، من خلال وضع أجهزة وقائية وإدراج عقوبات لمرتكبي هذه الجريمة، مع استحداث آليات وضمانات لحماية ضحايا هذه الجريمة Abstract : With the increasing spread of the crime of discrimination and hate speech, especially after the political situation that Algeria has experienced in recent years, the democratic openness and the proliferation of social media, which has become an enabling environment for the spread of discrimination and hate speech , what has become a threat to public order. In order to ensure that national unity and the exercise of fundamental freedoms are not compromised in various areas of life, the legislator issued legal texts that include mechanisms to prevent and limit this crime. Necessary to reduce this crime, through the development of preventive devices and the inclusion of penalties for the perpetrators of this crime, with the introduction of mechanisms and guarantees to protect the victims of this crime.
