Abstract
تتمحور هذه الدراسة حول "الفعالية" في منظومة التحكيم التجاري، باعتباره وسيلة بديلة لفض المنازعات، بل هو "نظام قضائي خاص" فرضته حتمية التجارة المعاصرة للتحلل من جمود القوانين الوطنية وبطء العدالة التقليدية كما تطرقت المذكرة لمدى نجاعة التحكيم في الموازنة بين سلطان الإرادة كمصدر للشرعية وبين السيادة القضائية (كأداة للرقابة، مع التركيز على العقبات القانونية التي تواجه نفاذ أحكام المحكمين، وعلى رأسها تأويلات "النظام العام". خلصت الدراسة إلى أن فعالية التحكيم لا تكمن في نصوصه فحسب، بل في إيجاد بيئة قضائية " تضمن تنفيذ الأحكام وحماية استقلاليتها، مقترحةً رؤية لتطوير الممارسة التحكيمية بما يضمن أمن الاستثمار وحماية المراكز القانونية في العقود التجارية المعقدة.
Abstract:
This research scrutinizes the "Paradigm of Effectiveness" within commercial arbitration, arguing that it has evolved from a mere alternative to a parallel judicial order necessitated by the exigencies of modern commerce. The study explores the intricate tension between party autonomy—as the source of arbitral legitimacy—and judicial sovereignty—as a regulatory constraint. It critically assesses the functional capability of arbitration to bypass the rigidity of national jurisdictions while navigating the "nebulous" concept of public policy (Ordre Public), which often hinders the enforcement of awards. By employing a multi-dimensional legal analysis, the study concludes that the true efficacy of arbitration is predicated upon a "pro-arbitration" judicial environment. It advocates for a specialized legal framework that minimizes judicial interference and reinforces the finality of arbitral decisions to ensure legal certainty in complex commercial transactions.
